Rental Terms and Conditions

1. The terms and conditions described here in aim to define the rules of use and the civil responsibilities of clients who enter into bicycle and surf rental and usage contracts with Caparica Bike Club. The client acknowledges and confirms that they have read and understood these terms and conditions, as well as their responsibilities.

2. The bicycles and equipment made available for rental to clients by Caparica Bike Club are the exclusive property of the company. They are intended for use in leisure rides or sightseeing tours. All equipment is in perfect working order and strictly complies with established safety standards.

3. When the customer submits their data on this platform, they declare and acknowledge that they have read and understood these conditions, as well as the rental agreement. The contract, signed before the rental, will include Caparica Bike Club's details, the customer's details, the equipment characteristics, the rental period, and the liability waiver.

4. The customer is responsible for all equipment included in the contract. It is always necessary to present an identification document when picking up the equipment.

5. In the case of minors, since they have a guardian, the contract holder immediately affirms that they are responsible for the minor(s).

6. Caparica Bike Club requires a security deposit of €200 to pick up any equipment. The deposit will be returned at the end of the contract, unless it is necessary to deduct any amount for repair expenses or services not contracted. The client hereby authorizes the retention of the security deposit for repair purposes.

7. In case of breakdowns, punctures or damage to the equipment, repair fees will be applied. The Client authorizes these adjustments to be made to the security deposit as soon as the adjustment amount is identified.

8. In case of loss of equipment, fees equivalent to the value of new equipment will be applied as indicated in the table below. The Client authorizes these adjustments to be made to the security deposit.

9. The security deposit does not cover the total value of the bicycles or equipment rented.

10. The Customer must always use all equipment prudently, maintaining its good condition, functionality, and safety, and respect all traffic rules.

11. The Customer must always use a security lock on the bicycles and choose a suitable place to store the bicycle.

12. The helmet and surf equipment must always be with the customer and must not be left out of the customer's reach.

13. In case of theft or loss of the helmet or surf equipment, the customer will be held responsible and will have to pay the full value of the lost or stolen equipment.

14. The Customer may not transport third parties on the rented bicycle, except in child seats weighing up to 18 kg. Furthermore, the Customer may not transfer or sublet the bicycle, nor participate in any type of sporting events or similar situations without authorization.

15. The use of a helmet is mandatory, and in case of an accident, if the customer does not have a helmet, it is the client's responsibility.

16. The rental price varies depending on the bicycle and the rental period. It is important to check the pricing conditions in the store or on the website.

17. The customer must return the equipment included in the rental agreement to the location specified in the contract.

18. If the rented item is not returned to the location and within the time frame established in this contract, a fee of €10 will be applied for each additional half hour.

19. The owner acknowledges and agrees that failure to return the rented item constitutes a breach of contract and may be treated as theft, subject to legal action and filing of a criminal complaint.

20. If the equipment is returned before the end of the contract, there will be no refund or adjustment of value.

21. Whenever changes to the contract are necessary, only increases in value are accepted, such as increasing the number of rental days. These changes must be communicated before the end date of the contract and must be communicated by email or message and duly accepted. In this case, a payment request for the increase in value will be sent, which must be paid before the end date of the contract. These settlements cannot be made through a security deposit.

22. Reservations guarantee the availability of equipment for the scheduled day and time. Our operating hours are from 9:00 AM to 6:00 PM.

23. For the reservation to be considered, a 50% payment is required, and the remainder is paid on-site at the time of equipment collection.

24. For cancellations made up to 2 days prior to the rental, the reservation payment will be refunded; after this date, no refunds will be issued.

25. In case of damage to the rented bicycle, the customer is responsible for returning to our store for equipment replacement. We do not provide a customer pick-up service.

26. Caparica Bike Club is not responsible for any accidents that may occur during the rental period, both bicycle rentals and surf equipment. It is important to note that the Client is entirely responsible for their own actions and must comply with all the rules of the country's road code while using the equipment.

27. By using Caparica Bike Club services, the Client agrees to assume full responsibility for any accident, personal injury or property damage that may occur during the rental period.

28. It is important that the Customer is fully aware of the risks involved in using bicycles and surfing equipment and complies with all appropriate safety measures to minimize such risks.

29. Deposit Table. In case of damage or loss of equipment, the customer must pay Caparica Bike Club the following amounts (VAT included):
